Seller Terms & Conditions

Introductory Note
These Seller Terms & Conditions apply only to sellers using the MyTiangge platform. They govern:

  1. Your relationship with MyTiangge as a platform provider; and
  2. Your responsibilities when dealing with buyers through the platform.

Buyer-facing rights and protections are published separately under the Buyer Terms of Service.

 


1. Purpose

These Terms & Conditions apply to all partners who sell goods, digital products, food, or services through the MyTiangge platform. By registering as a seller, you agree to follow these rules to ensure a safe and fair experience for everyone.

2. Registration

  • Sellers must provide accurate business and contact details.
  • MyTiangge may approve, reject, or suspend any seller account at its discretion.
  • Sellers are responsible for keeping profile information updated and login credentials secure.

3. Products & Services

  • List only legal, authentic, and safe-to-sell items.
  • Prohibited items include counterfeit goods, illegal substances, restricted medicines, weapons, and any item restricted under Philippine law.
  • Food vendors must comply with applicable food safety and local health regulations.
  • Service providers must deliver services as described in their listings.
  • Do not list age-restricted items (e.g., alcohol, tobacco, adult content) without proper compliance under Philippine law.
  • Do not knowingly collect data from minors under 18.

4. Pricing & Commissions

  • Sellers set their own prices.
  • MyTiangge charges a commission on each completed sale (as agreed during registration).
  • Payouts are made after deducting applicable fees.
  • Prices shown to buyers are determined solely by sellers.

5. Orders & Fulfillment

  • Prepare, pack, and deliver orders on time and as described.
  • If you cannot fulfill an order, notify the buyer and MyTiangge immediately.
  • Repeated fulfillment failures may lead to suspension or removal.

6. Payments & Security

  • Payouts will only be made to the seller’s registered payment account.
  • Provide accurate bank/GCash details to avoid delays.
  • Disputes and chargebacks may delay payouts while under review.
  • Payment processing fees are non-refundable, including when buyer refunds are issued, unless otherwise agreed in writing.

7. Customer Service, Refunds & Disputes

  • Respond to buyer inquiries promptly and professionally.
  • Honor your own return/refund commitments as posted on your shop page.
  • Manage refunds, returns, or replacements in line with MyTiangge’s refund policy.
  • For any return or refund, payment gateway processing fees are not returned and will not be credited back to the seller or buyer.
  • MyTiangge may act as a neutral mediator in disputes, but the final resolution and obligations remain the seller’s responsibility.

8. Data Handling & Privacy

  • Use buyer information (name, contact number, address, etc.) only to fulfill the order.
  • Do not store, sell, or share buyer information outside the transaction.
  • Any misuse of buyer data (e.g., unsolicited marketing, sharing with third parties) is prohibited and may result in suspension or removal.

9. Seller Compliance

Business & Tax Compliance

  • All sellers on MyTiangge are independent businesses. Each seller is solely responsible for securing their own permits, licenses, and registrations (e.g., DTI/SEC registration, BIR Certificate of Registration, business permits) as may be required by law.
  • Sellers are solely responsible for reporting and paying any applicable taxes (including but not limited to income tax, percentage tax, or VAT) arising from their sales.
  • MyTiangge does not act as a withholding agent or tax collector for seller transactions. The platform only collects commissions and service fees on orders and will issue its own official receipts/invoices for those fees.
  • By using the platform, sellers agree that MyTiangge shall not be liable for penalties, claims, or losses arising from a seller’s failure to comply with Philippine tax or business registration requirements.

10. Courier Accountability – Delivery Failures

Buyer Protection

  • Do not automatically charge buyers for a failed delivery if a courier falsely marks an order as “buyer not home” without a genuine attempt.
  • Buyers will not be penalized for courier abuse.
  • Disputed “not home” cases must be escalated by the seller to the courier before any re-shipping charges apply.

Seller Protection

  • Sellers are not liable for losses caused by couriers who fail to attempt delivery, mishandle items, or falsely mark orders as delivered.
  • Immediately raise a ticket with the courier and provide any available proof (e.g., chat logs, CCTV pickup evidence, rider communications).
  • MyTiangge can confirm platform transaction records but does not reimburse courier-related losses.

Food & Same-Day Deliveries

  • Food is perishable and cannot be re-delivered the next day.
  • If a buyer is unreachable (wrong pin, incorrect number, no response after rider attempts contact), the order may be marked as completed and no refund is due.
  • If the courier fails to attempt delivery and blames the buyer, the seller must escalate directly to the courier; buyers will not be charged unfairly.

11. Code of Conduct

  • Treat customers, riders, and fellow sellers with respect.
  • No misleading listings, fake promotions, or attempts to transact outside the platform.
  • Policy violations may result in suspension or removal.

12. Liability

  • Sellers are fully responsible for the quality, legality, and safety of their products/services.
  • MyTiangge acts only as an online platform provider and is not liable for damages, claims, or disputes arising from a seller’s products or services.

13. Amendments

These Terms & Conditions may be updated from time to time. Sellers will be notified of material changes. Continued use of the platform indicates acceptance of the updated terms.
